Contract of Services
between Rebecca Coles and a Company for freelance/sub-contractor services
The services, dates and pay rate will be confirmed via email. The following clarifies generic points for all work.
By responding to the email with the link this is considered agreeing to the below.
PAYMENT
1.1 Payment to be made by BACS within 2 weeks of receipt of invoice.

1.2 Late payment of will incur interest charges of 15% APR.
HOURS OF WORK
2.1 The day rate agreed, unless otherwise stipulated at the time of engagement, is for an 8 hour.
2.2 If future hours are asked for it will be charged pro rata.
EXPENSES
3.1 If it is required as part of the job to pick up, down off or drive, due to clients not having a vehicle and/or being unable to share the driving, then expenses will be charged at 25p a mile for driving these clients. The vehicle used is insured from business use.
3.2 Unavoidable parking fees will be charged as expenses.
3.3 Loss or damage to equipment by the client/group will be charged to the employer. Examples of this equipment include rope, rack, group shelter, spare compass but excludes personal clothing and PPE. General wear and tear is excluded.
CANCELLATION
4.1 Cancellation within 2 weeks of work will incur a charge of 50% fee. Cancellation within one week will incur a charge of 100% of fee.
LIABILITY AND EMPLOYMENT STATUS
5.1 The EMPLOYER has the responsibility to notify if the freelancer is sub-contracted ‘labour only’ or fully sub-contracted.
5.2 If the freelancer is being employed or sub-contracted ‘labour-only’ the EMPLOYER must hold employer’s liability insurance, public and professional liability insurance.
5.3 If the freelancer is working as an employee or sub-contractor ‘labour-only’ it is the EMPLOYER’S responsibility to provide risk assessments and operating procedures.
5.4 As an EMPLOYER engaging a freelancer in a sub-contractor ‘labour-only’ capacity will be responsible for contacting the client/group and is responsible for booking information, next of kin, medical information and participation statements. It is the EMPOYER’S responsibility to pass on relevant information to the Sub-contractor.
5.5 REBECCA COLES holds the following insurance Public Liability insurance up to £5,000,000 Professional Liability insurance up to £5,000,000 For mountain activities which fall within the remit of the IML and WMCI awards.
5.6 Working as a full SUB-CONTRACTOR. The company is to communicate this and both parties understand that REBECCA COLES will be working under her own risk assessments and operating procedures.
5.7 In a fully sub-contracted capacity REBECCA COLES is responsibility to keeping her risk assessments and operating procedures up-to-date.
PHOTO and VIDEO COPYRIGHT
6.1 Unless the client or company does not wish for photos and video being shared, these maybe be shared on Roam Mountains social media with the company being worked for tagged in posts.
6.2 If the company wishes to use photographs or video taken by REBECCA COLES it must be credited as either REBECCA COLES or tagged as Roam Mountains
